Introduction

These Terms of Service ("Terms") establish a legally binding agreement between the operator of the website "Tuitioned" (tuition-ed.com) (referred to as "Tuitioned," "we," "us," or "our"), tutors who provide services through our platform ("Tutors"), and individuals seeking tutoring services through Tuitioned ("Consumers"). Access to and use of Tuitioned is conditioned on your acceptance of and compliance with these terms. These terms apply to all users of the site.

Services

● Tuitioned offers an online platform that connects Consumers with qualified Tutors.
● Services provided include, but are not limited to, subject-specific tutoring, test preparation, and homework assistance.
● Tuitioned allows Consumers to search for Tutors based on subject matter, experience, availability, and hourly rate.
● Tuitioned facilitates communication, scheduling, and secure payments between Consumers and Tutors.

Eligibility

● Tutors: Tutors must be 18 years old and possess the necessary qualifications, experience, and background in the subjects they intend to tutor. Tutors must undergo a background check and verification process as mandated by Tuitioned.

Accounts

● Tuitioned requires the creation of an account to use the platform. You are responsible for the accuracy of the information provided.
● You are solely responsible for all activity on your account, including maintaining the security of your login credentials.
● Tuitioned reserves the right to suspend or terminate any account at its discretion, including those suspected of fraudulent or abusive activity.

Demo/Trial Class

● A single complimentary demo/trial class is available for new Consumers from one account.
● Demo/trial classes are subject to Tutor availability and typically have a time limit.

Fees and Payments

● Tutoring services are charged on an hourly basis. Tutor rates are clearly displayed and agreed upon by both the Consumer and Tutor prior to the start of tutoring sessions.
● Payment for tutoring services is processed securely through Tuitioned's integrated payment system.

Scheduling and Cancellation

● Scheduling of tutoring sessions is done through Tuitioned. Consumers and Tutors are expected to mutually agree upon suitable dates and times.
● Consumers may cancel scheduled sessions with at least [Insert advance notice period] advance notice. Cancellations within the notice period will incur a cancellation fee.
● Tutors may cancel with reasonable notice and must endeavor to reschedule sessions promptly. Tuitioned may penalize Tutors for excessive cancellations.

Refunds

● No refunds will be processed if a Consumer cancels a scheduled session.
● Refunds may be considered on a limited basis, only if a scheduled session falls on a government-approved legal holiday in the Consumer's relevant region, country, state, or territory, as verified by zip code.

Intellectual Property

● Tuitioned and its content are protected by intellectual property laws. Do not reproduce or distribute materials without our written permission.
● Tutor-created materials for their sessions remain the property of the Tutor. Consumers have a limited license for personal use.

Conduct and Prohibited Activities

● Interactions between Consumers and Tutors should be respectful and professional at all times.
● Prohibited activities include: ○ Sharing sensitive personal information ○ Discrimination, harassment, or threats ○ Inappropriate or illegal behavior

Limitation of Liability

● Tuitioned's liability for any losses or damages you may suffer in connection with the use of our services is limited.
● The limitations will vary depending on the nature of your claim and will be specified in accordance with Indian law.

Disclaimer of Warranties

● Tuitioned's services are provided on an "as is" and "as available" basis. We make no guarantees about specific results, service quality, reliability, accuracy, or uninterrupted availability.

Governing Law and Dispute Resolution

● These Terms of Service are governed by the laws of India. The courts of Delhi, India shall have exclusive jurisdiction over disputes.
● We encourage disputes to be resolved through negotiation or mediation.

Modifications to the Terms of Service

● We may modify these Terms. Notice will be given on the homepage of our website. Your continued use signifies acceptance of the new Terms.
